Full terms of service are being drafted before public launch. Until then, the working understanding:

• The product is in private beta and provided as-is; features and endpoints may change while it settles.
• You're responsible for what you annotate and for having the right to install scripts on the sites you pointPencilmark at.
• Don't use the widget to collect data the site's own privacy policy wouldn't allow — masking is on by default, but you know your sites best.
• Beta is free; pricing will be announced before the hosted version leaves beta, and self-hosting remains available.
